Florida man sues Outback Steakhouse after toilet allegedly shattered as he used it

A Florida man has filed a lawsuit against Outback Steakhouse, alleging he suffered serious injuries after a toilet at one of the chain’s locations shattered while he was using it.

The complaint was filed on December 9 in the Fifth Judicial Circuit Court for Marion County and names Outback Steakhouse of Florida, LLC, as the defendant. The lawsuit stems from an incident that allegedly occurred on March 26 at the restaurant in Ocala, Florida.

According to court filings, Michael Green was visiting the restaurant when he entered the restroom and sat down on a toilet in the handicap stall. The complaint states that the toilet “suddenly shattered and collapsed” beneath him, causing him to fall.

Lawsuit claims toilet collapsed while customer was seated

Green alleges the incident resulted in “severe bodily injury.” His attorneys accuse the restaurant of negligence, claiming it failed to properly maintain and inspect the toilet. The filing specifically alleges the restaurant did not ensure the toilet was securely fastened to the floor.

The lawsuit further claims the restaurant knew or should have known about the “unreasonably dangerous condition” and failed to warn customers or take corrective action.

As a result of the incident, Green claims he suffered a “significant and permanent loss of an important bodily function and/or permanent and significant scarring,” along with pain and suffering, medical expenses, and lost wages.

Green is seeking damages in excess of $50,000, exclusive of interest and costs.
